1. Acceptance of Terms
Welcome to Whyki! These Terms of Service ("Terms") govern your access to and use of the Whyki mobile application and related services (collectively, the "Service") provided by Whyki ("we," "us," or "our").
By creating an account, downloading the application, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
If you are under 18, you must have consent from a parent or legal guardian to use the Service.
2. Description of Service
Whyki is a free daily quotes and personal growth application. The Service delivers curated quotes across 10 topics, designed to inspire learning and personal development. Features include daily quote delivery, topic-based browsing, favorites, and personalized reading experiences.
The Service is provided free of charge. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
3. Account Registration
To access the Service, you must create an account. When registering, you agree to provide accurate and complete information and to keep it up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms or contain inaccurate information.
4. Content and Intellectual Property
The Service displays quotes attributed to their respective authors. Whyki does not claim ownership of the quotes themselves. The compilation, selection, arrangement, design, and presentation of content within the Service — including but not limited to the app interface, graphics, logos, icons, and software — are owned by Whyki and protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works based on the Service or its proprietary content without our written permission.
5. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or servers
- Reverse engineer, decompile, or disassemble any part of the Service
- Use bots, scrapers, or other automated means to access the Service
- Share your account credentials with others
- Scrape, copy, or redistribute the quote collections from the Service
- Harass or harm other users
6. User-Generated Content
If the Service allows you to save favorites, create collections, or submit any other content ("User Content"), you retain ownership of that content. By submitting User Content, you grant Whyki a non-exclusive, royalty-free license to use it solely for operating and improving the Service.
We may remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.
7. Third-Party Services
The Service may contain links to or integrations with third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party services. Your interaction with third-party services is at your own risk and subject to their respective terms.
8. Termination
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. You may delete your account at any time through the app settings or by contacting us.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will continue to apply, including intellectual property, disclaimers, and limitation of liability.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Quotes and content provided through the Service are for informational and inspirational purposes only. They do not constitute professional advice of any kind. The attribution of quotes is provided to the best of our knowledge but may not always be verified.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHYKI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
SINCE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100).
11. Indemnification
You agree to indemnify, defend, and hold harmless Whyki and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Service or violation of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ukraine. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Ukraine.
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
13. Changes to Terms
We may update these Terms at any time. Material changes will be communicated by updating this page and the "Last updated" date. We may also notify you through the app. Continued use of the Service after changes constitutes acceptance of the revised Terms.
